L’analisi della testimonianza ulpianea, tramandata in D. 7.8.12.4, consente non solo di guardare a un suggestivo profilo di storia sociale, quale è il mestiere dell’auriga nei giochi circensi dell’epoca, ma anche di approfondire una fattispecie di diritto di uso in cui il giurista ammette un’interpretazione delle facoltà di godimento dell’usuario in senso estensivo rispetto a quelle di consueto riconosciutegli.

The analysis of the testimony of Ulpianus, as can be read in D. 7.8.12.4, allows not only to look at a suggestive profile of social history, which is the profession of the charioteer in the circus games of the time, but also to deepen a case of right of use in which the jurist admits an interpretation of the faculty of enjoyment of the user in an extensive sense with respect to the usual concept.
