Se qualcuno utilizza materiali da costruzione di altra provenienza, e di proprietà altrui, inserendo così travi estranee sulla sua proprietà, si configura la fattispecie del tignum iunctum. Finché l’edificio rimane tale, stabilmente integro, il proprietario del materiale da costruzione non può richiederne la separazione dall’edificio. Da poche fonti, di natura controversa, è dimostrato che il proprietario del materiale da costruzione, ai fini del risarcimento, ha diritto a un actio de tigno iuncto per ottenere la sostituzione del valore dei materiali. La responsabilità del gestore del sito è prevista in tutte le fonti – dalle XII Tavole fino a quelle dell’epoca di Giustiniano – in duplum. Solo in un testo di Paolo (D. 46.3.98.8) si fa menzione del pretium – cioè del simplum – in luogo del duplum, motivo per cui tale frammento di Paolo viene considerato sospetto da parte della letteratura.
Abstract [Eng]
If someone uses a construction material from another person in such a way that foreign beams are inserted on his property, the case of the tignum iunctum is fulfilled. As long as the building is standing, the owner of the building material cannot request its separation. As compensation, the owner of the building material is entitled to an actio de tigno iuncto for value replacement; this is shown by the few controversial sources. The liability of the site manager is recorded in the sources throughout – from the XII Tables to the period of Justinian – on the duplum. Everywhere, except in the text of Paulus D. 46.3.98.8, where there is talk of the pretium – that is, simplum – and not of the duplum, which is why it is viewed with suspicion in literature.
