L’Autrice svolge un’indagine sui differenti strumenti di risoluzione e prevenzione della lite nell’ordinamento giuridico francese, che vengono denominati con l’acronimo M.A.R.L. (modes alternatifs de règlement des litiges).
L’obiettivo di questo lavoro è quello di indagare l’interazione fra autonomia privata e conflitto, distinguendo fra accordi conclusi prima, durante e dopo il processo.

The Author analyses the instruments of Alternative Dispute Resolutions (A.D.R.) in the French legal system, that are indicated with the acronym M.A.R.L. (modes alternatifs de règlement des litiges).
The purpose of this paper is to investigate the interaction between private autonomy and conflict, distinguishing between agreements concluded before, during and after the trial.
