L’Autore si occupa di analizzare la figura giuridica del modus in ambito contrattuale, distinguendolo, anzitutto, dalla situazione giuridico soggettiva dell’onere. Una volta ricostruita la nozione di modus sotto il profilo descrittivo, vengono individuate ed analizzate le diverse categorie giuridiche ad esso connesse. Il termine modus, infatti, può indicare sia la disposizione modale, sia l’obbligazione modale che ne costituisce l’effetto, sia la causa del contratto di donazione modale. L’Autore si interroga, altresì, sulla riconducibilità del modus nell’ambito degli elementi accidentali del contratto e sulla natura accessoria o autonoma dei suoi effetti rispetto alla donazione, soffermandosi, infine, sui riflessi applicativi del modus sulla causa della donazione sotto i profili della nullità o risoluzione del contratto.

The Author investigates the modus in the context of contract law by drawing a distinction with the burden (onere) and then by analyzing the legal categories connected. Modus, indeed, may indicate both the modal act of disposal, the related modal obligation, or the cause of the modal deed of gift. The question of whether the modus is an ancillary term of the contract (accidentalia negotii) and whether its effects are ancillary or autonomous with respect to the deed of gift are discussed. Finally, the effects of the modus on the cause of the deed of gift are interrogated, specifically in relation to the categories of the nullity or of the termination of the deed.
