Nel 2022 si prevedono alcune importanti novità in materia di antiriciclaggio. L’introduzione di un registro dei titolari effettivi finali sarà una delle più importanti, poiché rappresenta un importante passo avanti nella lotta ai capitali illeciti finalizzati al riciclaggio di denaro. Inoltre, questa importante innovazione dovrebbe avere un effetto positivo anche in termini di antitrust e di tutela dei consumatori. La suddetta novità dovrebbe avere risvolti positivi in termini di trasparenza ed efficienza del mercato. Di conseguenza, per l’autorità antitrust dovrebbe essere più semplice definire l’ambito di mercato pertinente e individuare eventuali distorsioni. Il presente contributo, partendo dall’analisi dell’Autorità antitrust italiana, attraversa le implicazioni positive che il registro del titolare effettivo dovrebbe apportare ai consumatori nel mercato europeo.

Some important changes in the anti-money laundering are arising in 2022. Introducing a register of the ultimate beneficial owners will be one of the most important, as it is a major step forward in combating illicit capital aimed at money laundering. Moreover, this important innovation should also have a positive effect in terms of antitrust and consumer protection. The aforementioned novelty should have positive implications in terms of market transparency and efficient. Consequently for the antitrust authority should be easier to define the scope of the relevant market and identifying any distortions. This paper, starting from the analysis of the Italian antitrust authority, goes through the positive implication that the register of the ultimate beneficial owner should bring to the consumers in the European market.
