Abstract [Ita]

A partire dalla definizione del diritto all’immagine, il contributo analizza il rapporto tra il minore e l’immagine, con particolare attenzione alla capacità di agire del minore nelle scelte di carattere esistenziale. Viene, altresì, approfondita la tematica attinente al consenso del minore nella dimensione digitale e al ruolo genitoriale rispetto alla diffusione dell’immagine, con particolare attenzione al best interest of the child. Oggetto di analisi è, infine, la legge francese n. 2024-120 del 19 febbraio 2024, sul diritto all’immagine dei minori, che viene raffrontata con la proposta di legge italiana.

Abstract [Eng]

Starting from the definition of the right to the image, the article analyses the relationship between the child and the image, paying particular attention to the child's capacity to make existential choices. It also examines the question of the child's consent in the digital dimension and the role of parents with regard to the dissemination of the image, with particular reference to the best interests of the child. Finally, the French law n° 2024-120 of 19 February 2024 on the right to the image of minors is analysed and compared with the proposed Italian law.
