Abstract [Ita]

Il presente contributo delinea lo status giuridico delle donne nelle Ordenações Filipinas del XVI secolo, una legislazione molto particolare, tipicamente portoghese. Nell’Antichità, si può vedere che le donne, in molti sistemi giuridici, ricevevano un trattamento diverso. Questo status giuridico differenziato è stato osservato anche nel diritto romano, il quale limitava anche la capacità giuridica delle donne. Tali differenze non erano limitate ai diritti dell’Antichità, ma hanno segnato diversi ordinamenti giuridici nel corso della storia. Le Ordenações Filipinas, promulgate nel 1595 e in vigore in Brasile fino all’avvento del Codice Civile del 1916, attribuivano anche alle donne uno status peculiare, come le restrizioni alla capacità testamentaria, tra altre particolarità. Pertanto, sulla base dell’analisi delle disposizioni delle Ordenações, si spera contribuire allo studio dello status giuridico delle donne.

Abstract [Eng]

This article outlines the legal status of women in the Ordenações Filipinas of the 16th century, a very peculiar legislation, typically portuguese. In Antiquity, it can be seen that women, in many legal systems, received a different legal treatment. This differentiated legal status was also observed in Roman law, which also restricted the legal capacity of women. Such differences were not restricted to the rights of antiquity, but marked several legislations throughout history. The Ordenações Filipinas, promulgated in 1595 and in force in Brazil until the advent of the Civil Code of 1916, also attributed a peculiar status to women, such as restrictions on testamentary capacity, among other points. Thus, based on the analysis of the Ordenações’ provisions, it is expected to contribute to the study of women’s legal status.
