Il contributo segue il percorso della penus legata a partire dai contrasti giurisprudenziali caratteristici del I secolo a.C., quando il tipo di economia e di familia, a Roma, andava definitivamente tramutandosi. Il rinnovarsi delle prassi testamentarie, passate in rassegna fino all’exaequatio giustinianea tra legati e fedecommessi, fu tra le cause della parabola discendente del legatum penoris (benché l’autore non nasconda la possibilità che alcune testimonianze della giurisprudenza severiana ne avessero anticipato l’epilogo). Centrale nella vicenda è il ruolo di Quinto Mucio Scevola, del cui ricordo è congetturato un legame con alcune illustrazioni grafiche e pittoriche rinvenute in un nuovo sito archeologico romano.

The contribution follows the path of the penus legata, from the time of jurisprudential contrasts of the first century BC, when the type of economy and family, in Rome, was definitively changing. The renewal of the testamentary practices, reviewed until the Justinian exaequatio between legata and fideicommissa, was among the causes of the downward trend of legatum penoris (although the author does not hide the possibility that some opinions of the Severan jurisprudence may have anticipated the epilogue). Central to the story is the role of Quintus Mucius Scaevola, whose memory is conjectured as linked to some graphic and pictorial illustrations found in a new Roman archaeological site.
