Nel presente contributo, è esaminata la recente ri-costituzionalizzazione dell’insularità, in seguito all’arretramento derivato, su tale fronte, dalla riforma del 2001; il voto parlamentare con cui s’è sancita tale ri-costituzionalizzazione ha avuto luogo tra novembre 2021 e marzo 2022. In particolare, vengono poste in luce le criticità del testo licenziato dalle Camere, ad esito di un suo raffronto con – da una parte – la sentenza della Corte costituzionale n. 6/2019 e – dall’altra – la formulazione originaria, contenuta nella relativa proposta.

In this contribution, the recent re-constitutionalization of insularity is examined, following the withdrawal derived, on this front, from the 2001 reform; the parliamentary vote by which this re-constitutionalization was set forth took place between November 2021 and March 2022. In particular, the critical issues of the text dismissed by the Chambers are highlighted, as a result of a comparison with – on the one hand – the ruling of the Constitutional Court no. 6/2019 and – on the other – the original wording, contained in the related proposal.
